The car was bought by a private individual When the car is bought by a private person, the Purchase Act applies. 

The cancellation provision can be found in section 39 of the Purchase Act. It states;

"The buyer can cancel the purchase if the defect results in a significant breach of

contract"

There must therefore be a significant breach of contract. If cheating with the mileage is a "significant breach of contract", I will return to.
