How likely is a person to be found guilty of a DUI, if the person does not commit any moving violations that might indicate impairment (e.g. being pulled over for a broken tail light?)

Based on my experience as a prosecutor in Vancouver, B.C., my estimate is that 20% of the impaired driving related files began with a traffic infraction witnessed by the officer, 10% began with a motor vehicle accident, 5% were civilian complaints of bad driving, and the rest were random stops, usually impaired driving roadblocks.

The law in Canada is different than in the U.S. A breath test over .080 hardly guaranteed a conviction… .180, .280… you be surprised at some of the cases that resulted in acquittals.

But I assume you’re asking about the odds of being stopped if you’re drunk, but drive carefully. My advice: just don’t. Take a cab. Getting a lawyer is expensive. (Not getting a lawyer can be even more expensive.)
