Pune August 2, 2019: The Bombay High Court vide its order of July 24, 2019 has dismissed a restoration application in relation to a dismissed Public Interest Litigation (PIL) filed against Avinash Bhosale Group & Others, by petitioners Rajesh Bajaj & Others. Dismissing the said application, Court of Hon’ble Chief Justice of Bombay High Court, observed that some people abuse the tool of PIL and the many of such litigations are found to be filed to extort money from third parties. The Hon’ble Court has also opined that, those who claim to espouse public causes, need to be of highest character them-self.
The dismissed PIL was filed in 2015 against Avinash Bhosale Group’s residential project called Castel Royale Towers at Bhosale Nagar by Rajesh Khairatilal Bajaj & Others resident of Pune.
The Petition first came to be dismissed in the year 2016 on account of defaults on the part of petitioner. During the last hearing on the subject, before Hon’ble Court, One of the petitioner attempted to take the shield of viral fever and ongoing medical treatment to justify defaults. However, it came to the notice of the Hon’ble Court that on record, the facts substantiate that Petitioner was prosecuting a Criminal Complaint, during the earlier dates when default occurred. Further to that, a suspicious medical certificate was also filed by the petitioner, while another petitioner Rajesh Bajaj was found to be masquerading as a lawyer contrary to the facts as Hon’ble Court also earlier took note of.
Speaking on the verdict, Mr. Amit Bhosale, Managing Director, Avinash Bhosale Group said, “We were repeatedly attempted to be defamed by certain self-titled RTI activists, but we have continued our faith in judiciary and the truth has finally prevailed. We are sure that such orders will act as deterrent against such false litigations. The RTI act and such other tools like PIL, are time and again misused and utilized for motivated intentions and that should stop.”
